General Terms and Conditions
§1 Bookings (by phone, fewo-direkt.com, or via the website www.hotelcomenius.de)
(1) By clicking the booking button, you confirm the booking for the selected accommodation at the specified price and period. The landlord is Community Hotel GmbH, Paul-Schneider-Str. 17, 14513 Teltow. Following your booking, you will receive a booking confirmation by email as a guest/tenant. The landlord rents out to the tenant the accommodation described in the booking confirmation, including the complete identification data (identity card/passport, bank details/credit card details), duration of the contractual relationship, the number of persons residing in the rental property, the final price, and its components: individual prices for overnight stays, cleaning fee, city tax, means of payment, and payment method.
(2) The tenant accepts the house rules and the conditions in §4 Liability and Tenant Obligations without restriction. The attached house rules apply.
(3) The rental property is fully furnished and rented out with the equipment described in the advertisement. The equipment is owned by the landlord and is possessed by the tenant during the specified period. The tenant assumes responsibility for the order and care of the equipment (proper handling of inventory, washing dishes, and waste disposal) during the designated period.
(4) The tenant will receive house/apartment keys for the duration of the rental period. The costs arising from loss or damage to the keys or locking systems will be borne by the tenant.
(5) Check-in is from 3:00 pm on the arrival day.
(6) Check-out is by 10:00 am on the departure day.
(7) We strive to accommodate reservation changes but reserve the right not to grant them.
§2 Payment
(1) The rental price is based on the final amount in the booking confirmation. The final amount stated there applies for the duration of the specified rental period, including the cost of a one-time final cleaning.
(2) Payment is primarily made using the credit card provided by you. The full amount will be charged to your credit card upon booking. If the amount cannot be debited or the credit card is not valid, Community Hotel GmbH reserves the right to cancel the booking.
(3) Payment can also optionally be made to the specified bank account or PayPal after the tenant has requested consent from the landlord in writing and this consent has been confirmed in writing by the landlord with payment instructions.

§3 Cancellations
(1) The following cancellation conditions apply to completed direct bookings – by phone, fewo-direkt.com, or via the website www.hotelcomenius.de:
– Cancellation up to 30 days before check-in is free of charge.
– For cancellations made 30 days or less before check-in, the cleaning fee will be refunded.
(2) If the tenant terminates the stay prematurely, they remain obligated to pay the full rental price.
(3) Cancellation or termination can only be made in writing. The date of receipt of the declaration by the landlord is decisive.
(4) For bookings made not by phone or through www.hotelcomenius.de, the cancellation conditions posted on the portal apply.
§4 Liability and Tenant Obligations – House Rules
(1) The rental property, including furniture and other items therein, must be treated with care. The tenant is responsible for ensuring that accompanying and/or visiting persons exercise due care. The tenant is liable for any damages to the rental property, furniture, or other items in the rental property caused by them or accompanying persons.
(2) Defects occurring upon takeover of the rental property and/or during the rental period must be reported to the landlord immediately in an appropriate manner. If the defect is not reported immediately, there is no entitlement to damages or discounts. This particularly applies to damage reports after the stay, which the landlord can rectify in a timely manner.
(3) The rental property is a non-smoking property. In the event of a violation, a penalty equivalent to two daily rates is due.
(4) The tenant must dispose of any waste generated by them no later than upon departure. Suitable waste disposal facilities are provided in the courtyards.
(5) Keeping pets is not allowed. In the event of a violation, the tenant bears the costs for anti-allergic treatment of the property in full.
(6) A fee of 100 euros will be charged for lost keys.
(7) Quiet hours are observed after 10:00 pm. Hosting parties is not allowed. In the event of disturbances, the landlord reserves the right to exercise their right of domicile and expel guests from the apartment.
(8) The tenant undertakes to adhere to the house rules stated here.
§5 Written Form, Severability Clause, Updates
(1) Changes and additions to this contract require written form. This also applies to changes to this written form clause.
(2) If any provision of these conditions is found to be invalid or unenforceable, that provision will be struck, and the validity and enforceability of the remaining provisions will remain unaffected.
(3) Should individual provisions of this contract be or become invalid or unenforceable after conclusion of the contract, the validity of the contract as a whole shall not be affected thereby. In place of the invalid or unenforceable provision, the economically closest effective and enforceable provision shall be deemed agreed upon, which the contracting parties would have agreed upon according to the purpose of the contract, if they had been aware of the invalidity or unenforceability of the provision.
(4) In the event that you conclude the contract with a person who does not reside in your country: The contract is subject to the law of the Federal Republic of Germany with the registered office in Potsdam.
(5) We reserve the right to update these terms and conditions at any time without prior notice. Any changes to these terms and conditions will be announced on the hotelcomenius.de website or services and will take effect immediately upon announcement. If you continue to use hotelcomenius.de after the announcement of changes, you agree to the updated terms and conditions and accept them as binding. If you do not agree with the changed terms and conditions, you must immediately discontinue the use of hotelcomenius.de.
